There is often quite a bit of confusion over which term to use for which form of intellectual property and the protection thereof. Each of the marks-trademarks, copyrights, patents and servicemarks serve a different purpose:
1. Trademarks and Servicemarks are much the same thing except that a trademark refers to a product and a servicemark refers to a service. Each of these devices are a word, a symbol, a name or some other mark that is used to indicate the source of the goods or service and to distinguish them from that of another. They are often both referred to as a “mark” or “marks” and the word “trademark” is also sometimes used in reference to a servicemark. These marks will not prevent others from offering a product or service of the same kind under a completely different mark, but prevents others from using a confusingly similar mark, which, of course, can result in large revenue losses and diluting of the brand. Trademarks that are used in interstate or foreign commerce may also be registered with the Patent and Trademark Office. These symbols (O or SM) are interchangeable for a servicemark symbol. ™ is also acceptable for that use. The symbol (™) stands for “trademark” and the symbol (®) denotes a “registered trademark”.
